1.1 Mapmelon is a platform and service (the "Platform") which facilitates digital nomads in booking accommodations, either via our website or other electronic facilities ("Online Booking"). As part of the Platform, we connect our clients and customers ("you") with accommodation providers ("Suppliers").
1.2 Please note that we are not a travel services business and we do not book flights for you. All our services cater to digital nomads and professionals seeking accommodations.
1.3 The Platform is owned and operated by Matcha Solutions LLC ("Mapmelon", "we", "us", or "our"), a limited liability company registered in Delaware. If you have a query or would like to speak to us about these terms, please contact us.
1.4 These terms and conditions apply to all services ("Services") provided or arranged by us. These terms are in addition to applicable Supplier terms.
1.5 Your engagement with Suppliers will be governed by the Supplier terms. We will not be a party to any agreement for accommodations provided by Suppliers. We do not own, control, or manage any Suppliers listed on the Platform.
1.6 These terms and conditions will apply at any time when you use our services and by continuing to use the Platform you accept these terms and conditions.
1.7 These Terms may be amended from time to time. Any amendments or new terms and conditions will be available on our Platform. You may terminate this Agreement if you do not wish to be bound by any such amendments but by continuing to use our Platform you will be deemed to have accepted the new terms.
2.1 Access to the Platform doesn't require registration. However, to book accommodations, an account is necessary.
2.2 To register or make a booking, you must provide certain information, including a valid email address and credit card details. All personal information provided will be subject to our data protection obligations.
2.3 You will create a password upon registration. Keep it confidential; any third-party access using your password will be deemed as your agent's actions.
2.4 Supply a valid email address for booking confirmations and other information. Any failure in communication due to an invalid email address is not our responsibility.
2.5 Inform us promptly if you provide an incorrect email or if a third-party gains access to your password.
2.6 We can suspend or close your account for any breach of this Agreement.
3.1 Bookings via Mapmelon are facilitated through a Confirmation Email, which signifies a binding agreement for the provision of services from the Suppliers.
3.2 At the time of booking, Mapmelon charges a booking fee equal to 10% of the total amount (the "Mapmelon Fee"). This serves as the booking deposit. The remaining balance must be paid directly to the Supplier, either before arrival or upon arrival.
4.1 Mapmelon offers Suppliers a platform to market their accommodations.
4.2 We aim for quality assurance, but we provide no warranty about the Supplier's suitability.
4.3 Post-booking confirmation, we have no further obligation regarding Suppliers.
5.1 You agree to address disputes directly with Suppliers. We won't withhold or recover payments on your behalf.
6.1 At the time of booking, Mapmelon charges a non-refundable booking fee equal to 10% of the total booking amount (the "Mapmelon Fee"). This serves as the booking deposit.
6.2 The remaining balance of the booking must be paid directly to the Supplier, either before arrival or upon arrival.
6.3 Any additional security deposits required by the Supplier (for example, for damages) are arranged directly between you and the Supplier. Mapmelon does not process or hold these amounts.
6.4 Cancellation policies are determined by Suppliers and are displayed in their listings. Mapmelon offers three standard cancellation options that Suppliers may choose from:
6.5 If a Supplier has not specified a cancellation policy, Mapmelon's standard cancellation policy applies.
6.6 If a Supplier cancels your booking, you will receive a refund of the deposit paid, including the Mapmelon Fee, unless you voluntarily accept an alternative arrangement offered by the Supplier (such as alternative dates or accommodation).
6.7 Mapmelon is not responsible for Supplier-initiated cancellations. The Supplier is responsible for honoring all confirmed bookings and providing refunds where applicable.
7.1 Respect and adhere to this Agreement.
7.2 For 12 months post-introduction to a Supplier via Mapmelon, refrain from direct bookings bypassing Mapmelon.
8.1 We can suspend your Account if there's any breach of this Agreement.
8.2 If suspended, your access might be restricted.
8.3 Termination grounds include breaches, suspected breaches, or insolvency.
8.4 Post-termination, access will be restricted.
You agree to indemnify us against claims or legal proceedings due to breaches or actions concerning our services.
10.1 We aren't liable for indirect losses or for any consequential or indirect loss such as loss to reputation.
10.2 Liability is excluded for any issues arising from your engagement with Suppliers.
10.3 Our liability is capped to the commission we receive for bookings.
10.4 Claims against us can't be brought more than 12 months post-event.
10.5 We're liable for any damages resulting from our negligence leading to personal injury or death.
10.6 Our liability is limited, especially since we only facilitate connections with Suppliers.
11.1 We adhere to applicable data protection and privacy laws.
11.2 Our Privacy Notice details our commitment to data protection.
12.1 Both parties commit to maintaining confidentiality unless required by law.
13.1 Both parties agree to these terms.
13.2 Entering this Agreement implies acceptance of our Privacy Notice.
13.3 Notices to parties should be sent via registered means.
13.4 This Agreement doesn't grant any third-party rights.
13.5 Assignments and sub-contracts of our obligations are permissible.
13.6 Both parties are released from obligations in cases of national emergencies, wars, or governmental prohibitions.
13.7 The entire Agreement is between both parties.
13.8 By agreeing, you accept these terms as fair and reasonable.
13.9 Invalidity of any term doesn't affect the Agreement's validity.
13.10 Both parties will act in good faith.
13.11 Headings are for reference only.
13.12 This Agreement is governed by Delaware law.
